Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TapeAlert service ("Service"), operated by Melotte Consulting ("we", "us", or "our").
Please read these Terms carefully. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
1. Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding your account and for any activities or actions under your account. You agree not to share your credentials with any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Subscriptions
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are typically monthly or annual.
At the end of each Billing Cycle, your subscription will automatically renew unless you or we cancel it. You may cancel your subscription renewal either through your online account management page or by contacting customer support.
A valid payment method is required to process the payment for your subscription. Payment methods may include credit cards, debit cards, or other payment methods that we support. You shall provide accurate and complete information regarding your chosen payment method.
If automatic billing fails for any reason, we may attempt to charge the payment method on file one or more times. If payment continues to fail, we may restrict your access to the Service or terminate your subscription.
3. Fee Changes
We reserve the right to modify our subscription fees at any time. If we do change our fees, we will provide notice of the change on our website or via email to you at least 14 days before the change takes effect.
Your continued use of the Service after the fee change becomes effective constitutes your agreement to pay the modified fees.
4. Refunds
Except when required by law, paid subscription fees are non-refundable.
5. Service Usage and Limitations
Our Service has usage limits based on your subscription plan. These limits are clearly defined in your plan details.
We will not charge you for exceeding these limits automatically, but we may restrict functionality or limit further usage until you upgrade your plan or the next billing cycle begins.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Melotte Consulting and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Melotte Consulting.
7. User Content
Our Service allows you to process notifications and webhooks containing data that you provide ("User Content"). You are responsible for the User Content that you post, upload, link to, or otherwise make available via the Service.
You retain all rights to your User Content, and you are responsible for protecting those rights as appropriate. By posting User Content through the Service, you grant us a license to use, store, and process such content in connection with providing the Service.
You represent and warrant that:
- You either own the User Content or have the right to use it and grant us the rights as provided in these Terms
- The posting and use of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity
8. Prohibited Uses
You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use our Service:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation
- To impersonate or attempt to impersonate our company, an employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm us or users of the Service
- To use the Service in any manner that could disable, overburden, damage, or impair the Service
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
10. Limitation of Liability
In no event shall Melotte Consulting, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
11. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
